The current definition includes death, dismemberment, significant disfigurement, fracture, loss of a fetus, permanent loss of use, permanent consequential limitation, and significant limitation of a body function or system.
The former “90/180-day” category was removed in 2026. Objective medical proof is, therefore, especially important. Examinations, imaging, quantified range-of-motion findings, specialist opinions, and a medically supported explanation for any treatment interruption may determine whether the claim survives a threshold motion. A diagnosis alone may not suffice; the proof must connect an objectively demonstrated limitation to the collision and address evidence of degeneration or prior injury.

Why Fault Analysis Changed in 2026
New York no longer applies pure comparative negligence to every motor-vehicle personal-injury action. Under the current law, a claimant in a personal-injury action subject to Insurance Law Article 51 is barred from recovery if the claimant’s culpable conduct exceeds that of the defendant or the combined culpable conduct of the defendants. If the claimant is not barred under that rule, damages are reduced in proportion to the claimant’s culpable conduct.
This amendment took effect May 26, 2026, and applies to actions and proceedings commenced on or after that date. Intersection video, event-data recorders, cellphone evidence, vehicle damage, and independent witnesses may affect whether an injured driver is placed above or below the recovery threshold.
